According to article No. 236 of the Labor Code of the Russian Federation, for delayed wages, compensation is required, the amount of which must be specified in the internal legal acts of the enterprise, but cannot be lower than 1/300 of the refinancing rate of the Central Bank of the Russian Federation. Location: Location: If you were untimely paid your wages, and it must be paid at least twice a month with equal intervals of time, then you have the right to contact the labor inspection, prosecutor's office or court. Write a statement, indicate the amount of wages, delay times.

You have the right to receive compensation not only for delayed wages, but also for late payment of vacation pay, compensation for unused vacation, payment upon dismissal and other amounts due to you.

In accordance with your application, the authorized representatives of these instances will oblige the employer not only to pay off the entire amount of wage arrears, but also to charge compensation in accordance with the instructions of the company's internal legal acts, but not less than 1/300 of the total amount owed for each delayed day.

Compensation for late payment of wages is calculated using a formula in which the salary must be multiplied by 1/300 and multiplied by the number of days overdue for payments, unless otherwise specified in internal legal acts. For example, if your salary is 20 thousand, the delay is 60 days, then you will receive compensation equal to 4000 thousand rubles. The amount of payments for one day of delay will be equal to 66.67 rubles.

If other compensation is indicated in the internal acts of the enterprise, then make the calculation based on the actual interest rates. For example, if a compensation payment is indicated in the amount of 1/200, then divide the salary by 200 and multiply by the number of days overdue. In the example considered, the amount will be equal to 100 rubles in one day, and 6000 rubles in 60 days.

If the employer does not agree with the claims made to repay salaries to employees and calculate compensation for each delayed day, then he will be charged a large administrative fine. Also, the work of the enterprise can be suspended for up to 90 days, which are given for full settlement with employees.
